How does This Is My Band handle inappropriate content?
When This Is My Band users identify inappropriate content, as described in our Terms of Use and Community Guidelines, they are able to flag the video or audio. Each flagged video audio is promptly reviewed by our administrators who immediately remove any content that violates the Terms of Use.
What kinds of video and audio content can I upload?

How do I flag inappropriate videos and audios?
If you see a video or hear an audio that you think is inappropriate based on our Terms of Use (http://www.thisismyband.com/terms.php), you can report it to us for review by clicking the "Flag as Inappropriate" link at the bottom of the "WATCH" or "LISTEN" pages. Please only flag videos and audios that you feel really break our Terms of Use.
What kinds of commercial uses of the This Is My Band website are prohibited, and which aren't?
Our Terms of Service clarify what kinds of uses of the website and the This Is My Band Embeddable Players are permitted. We don't want to discourage you from putting the occasional This Is My Band video or audio in your blog to comment on it or show your readers a video or let them hear an audio you like, even if you have general purpose ads somewhere on your blog. We will, however, enforce our Terms of Service against, say, a website that does nothing more than aggregate a bunch of embedded This Is My Band videos and audios and intentionally tries to generate ad revenue from them.
How do I block another member?
You can block users from making comments on your videos, audios or sending you messages. To block a user, go to their Profile and click the "Block User" button.
Similarly, you can unblock users by returning to their profile and clicking the "Unblock User" button where the "Block User" button used to be.
How do I file a DMCA complaint?
Copyright Infringement Notification
To file a copyright infringement notification with us, you will need to send a written communication that includes substantially the following (please consult your legal counsel or see Section 512(c)(3) of the Copyright Act to confirm these requirements):
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material. Providing URLs in the body of an email is the best way to help us locate content quickly.
- Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- The subscriber's name, address, and telephone number, and a statement that the subscriber consents to the jurisdiction of Federal District Court for the judicial district in which the address is located, or if the subscriber's address is outside of the United States, for any judicial district in which the service provider may be found, and that the subscriber will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.

What are you doing to prevent unauthorized copyrighted content from appearing on This Is My Band?
Since all content on This Is My Band is posted by our users, we make it clear in our terms of use and at the time of upload that they must own the copyright to the videos and audios they post or have permission from the copyright holder. We encourage copyright holders to report any specific infringing videos and audios via the DMCA takedown process. User accounts of repeat infringers are automatically terminated.
What if I believe I have been falsely accused of copyright infringement?
If you feel a content owner has misidentified your content as infringing, you may file a DMCA counter-notification.

What is your policy on copyright infringement?
This Is My Band respects the rights of copyright holders and publishers and requires all users to confirm they own the copyright or have permission from the copyright holder to upload content. We comply with the Digital Millennium Copyright Act (DMCA) and promptly remove content when properly notified. Repeat infringers' videos and audios are removed and their accounts are terminated and permanently blocked from using This Is My Band. Why was my video or audio removed for copyright while similar videos and audios were not?
When we are notified or otherwise become aware that a particular video or audio uploaded to our site infringes another's copyright, we respond promptly, as the law requires. If there remain videos or audios on the site that appear similar to the one(s) we've removed, we are likely either not aware of them or do not have reason to believe they are infringing. Sometimes a copyright owner authorizes some, but not all, of its works to appear on our site. Other times, very similar videos are owned by different copyright owners, and one may grant permission while another does not.
